Provisional governance for the 2026–27 school year v0.1 — discussion draft
Status: Proposed normative text for discussion. Newton Prep is authoring the draft. No nonprofit steward has been formed, no board has adopted this text, and no school has attained signatory status under it.
Purpose and effective period
Newton Prep may circulate a draft, invite comments from affected schools, families, officials, and other interested parties, publish a record of material comments and their disposition, and submit a provisional Standard to the board of a newly formed nonprofit steward. The target for board adoption is October 31, 2026. The provisional Standard becomes operative only on the effective date stated in a board resolution published with the adopted text and after the steward is able to accept signatories and carry out the duties in this section. It governs the balance of the 2026–27 school year, subject to the effective period stated in each adoption agreement.
The board shall publish the authoritative text, version, effective date, and any later amendments in a durable public location. Draft circulation, adoption by a school, or formation of the nonprofit alone does not establish that the Standard has been approved by ANSI or by UIL, TAPPS, SPC, or TASO.
Steward and board authority
The nonprofit is the steward. Its board is responsible for the official Standard and its administration. Subject to the nonprofit’s governing documents and the signatory agreements, the board shall:
- adopt and publish versions, interpretations, and amendments of the Standard;
- set signatory dues and approve the terms on which schools attain and retain signatory status;
- designate a contact for schools, opponents, and officials; arrange for reports, complaints, eligibility questions, and payment concerns to be received and acted on;
- appoint, oversee, and replace any program administrator or other service provider; and
- appoint independent decision makers and appeal reviewers and ensure that their decisions are implemented.
The board may delegate operations in writing but remains accountable for them. It shall not decide a contested matter through a director who has a material conflict in that matter. The board’s powers under this Standard must be reflected in the nonprofit’s governing documents and adoption agreements; this section does not itself create a corporation or confer corporate authority.
Consensus, conflicts, and records
For provisional policy decisions, the board shall seek consensus after giving materially affected signatories and other interested parties a reasonable opportunity to state and explain objections. Consensus means substantial agreement reached after good-faith consideration of material objections; it does not require unanimity or give any adopter a veto. The board shall record the decision, material objections, and reasons for accepting or rejecting proposed changes. A decision is authorized only through the vote, quorum, and notice procedures in the nonprofit’s governing documents.
Directors and other decision makers shall disclose financial, organizational, familial, and competitive interests that could affect a matter. A person with a material conflict shall not investigate, deliberate, or vote on that matter, except to provide requested information. The board shall record the disclosure and recusal and appoint a disinterested substitute when needed. The board shall maintain a public record of policy decisions and a protected record of individual cases, with student information disclosed only as needed to administer the Standard and applicable contests.
Urgent decisions and appeals
The board shall designate a disinterested person or panel with authority to make prompt, written interim decisions when delay would permit continued participation by a potentially ineligible student, leave an immediate safety or officials concern unaddressed, or materially prejudice an imminent contest. An interim decision shall state its factual basis, scope, effective time, and route to expedited review. It shall last only as long as necessary for a final decision under the adopted case procedures.
Before an adverse final eligibility or standing decision, the affected school and any person facing a participation restriction shall receive notice of the issue and material evidence, a meaningful opportunity to respond, and a written decision with reasons. A disinterested reviewer who did not make the initial decision shall hear a timely appeal. The board shall publish workable filing and decision deadlines before accepting signatories. Mediation may be offered but shall not delay a required eligibility or safety decision unless all affected parties and the decision maker agree that delay is permissible.
Development of the 2027–28 Standard
The board shall publish written procedures and a timetable for preparing the first regular Standard for the 2027–28 school year. The process shall be modeled on the due-process principles in the ANSI Essential Requirements: open notice and participation, outreach for balanced interests, consideration and documented resolution of written objections, a recorded consensus decision, and an impartial procedural appeal. The board shall identify relevant interest categories, including adopting schools, families and students, opponents, officials, and independent education or contest expertise, and shall take steps to prevent one interest from dominating the process.
The board shall publish each proposed substantive revision for comment, maintain a response record, and publish the adopted version and its effective date before schools are required to follow it. A new requirement shall not retroactively turn previously permitted conduct into a violation. The regular Standard shall state how pending cases and existing adoption agreements pass from the provisional version to the new version. Use of ANSI principles does not constitute ANSI accreditation or approval.
Adoption, exit, and continuity
Any school meeting the published signatory criteria may seek to adopt the provisional Standard. A school may withdraw prospectively and may copy or adapt the published text under its applicable license. Withdrawal or a fork does not authorize continued use of the steward’s conformance designation and does not extinguish payment, reporting, records, or case obligations arising during the school’s signatory period. The adoption agreement shall state the notice required for withdrawal and how pending matters are resolved.
Matters to settle before operation
- Form the nonprofit; adopt governing documents that specify board composition, selection, quorum, voting, conflicts, and removal.
- Identify the initial board and publish its authority, contact information, and the provisional adoption resolution.
- Complete the signatory agreement, dues schedule, case deadlines, decision-maker appointments, appeal process, and records rules before accepting signatories.
- Set the exact end date of the provisional period and the timetable for adoption of the 2027–28 Standard.
